Important Notice

By accessing, browsing, or using the Ourstube platform (including our website, mobile applications, and services), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use Ourstube.

These Terms constitute a legally binding agreement between you ("User," "Creator," "Viewer," or "you") and Ourstube ("we," "us," "our," or "Company").

1. Eligibility & Account Requirements

1.1 Age Requirements

• Users must be at least 13 years old to create an account on Ourstube
• Users under 18 are considered minors and must have parental or guardian consent to use paid features
• Users aged 13-17 have restricted access to certain features, including live streaming monetization and subscriber-only content creation
• Users must provide accurate age information during registration
• We reserve the right to verify age through identification documents for users claiming eligibility for restricted features

1.2 Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for choosing a secure password and keeping it confidential
• You agree not to create multiple accounts to circumvent policies, earn duplicate rewards, or evade enforcement actions
• One person may not operate more than one monetized account without explicit written permission
• Corporate or organizational accounts require verification and may have additional terms

1.3 Account Verification

• We may require identity verification for monetization eligibility, large payouts, or suspected policy violations
• Verification may include government ID, tax information, or payment method confirmation
• Failure to complete verification may result in account suspension or demonetization
• All information provided during verification must be truthful and accurate

1.4 Prohibited Account Types

You may not create an account if you are:

• A minor under 13 years old
• Previously banned or suspended from Ourstube
• Prohibited by law from using our services in your jurisdiction
• Acting on behalf of a sanctioned individual or entity
• Creating fake or misleading accounts impersonating others

2. Account Responsibility & Security

2.1 Your Responsibilities

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activity conducted under your account, whether authorized or unauthorized
• Notifying us immediately of any unauthorized access or security breach
• Reviewing and managing your account settings and privacy preferences
• Complying with all applicable laws and these Terms
• Keeping your contact information current and accurate

2.2 Account Security

• We recommend using a strong, unique password (minimum 12 characters with mixed case, numbers, and symbols)
• Enable two-factor authentication (2FA) to protect your account
• Never share your password, API keys, or authentication tokens with third parties
• Log out when accessing Ourstube from shared devices
• Monitor your account for suspicious activity and report it immediately

2.3 Unauthorized Access

If you suspect unauthorized access to your account:

1. Change your password immediately
2. Enable two-factor authentication if not already active
3. Review your login history and active sessions
4. Contact our security team at security@ourstube.com with details
5. We will investigate within 24-48 hours
6. You may request account recovery or credential reset assistance

We are not responsible for unauthorized access if you fail to maintain reasonable security practices.

2.4 Account Suspension & Recovery

If your account is compromised, we may:

• Temporarily suspend access while investigating
• Reset credentials and require re-authentication
• Lock monetization pending verification
• Require you to review and confirm recent activity

3. Content Ownership, Rights & Licensing

3.1 Your Content Rights

• You retain all ownership rights to any content you create and upload to Ourstube
• Ourstube does not claim ownership of your original content
• You remain the copyright holder and can delete, download, or modify your content at any time
• Deletion requests are processed within 30 days, though archived content may persist temporarily

3.2 License Grant to Ourstube

By uploading content to Ourstube, you automatically grant us a non-exclusive, worldwide, royalty-free, perpetual license to:

• Display and stream your content to viewers
• Create thumbnails and previews for promotional purposes
• Monetize the content through AdSense and AdMob advertising
• Include your content in recommendations and search results
• Distribute your content across our platform globally
• Create derivative works for platform functionality (compression, formatting, analytics)
• Archive your content for legal or historical purposes

This license does NOT grant Ourstube the right to:

• Claim ownership of your content
• Sell your content to third parties without your consent
• Remove your attribution or credit
• Use your content for purposes outside the Ourstube platform without permission
• Sublicense your content to competing platforms

3.3 Third-Party Content & Permissions

• You must own or have explicit written permission to upload all content
• If your content contains music, you must have proper licensing rights or use royalty-free alternatives
• If your content includes other creators' work, you must credit them clearly in descriptions
• Fair use, parody, commentary, and educational use must be substantial and transformative
• We will honor DMCA takedown requests for unauthorized copyrighted material

3.4 Content Attribution & Credits

• Always credit original creators and copyright holders
• Include proper attribution in your video description
• Link to original creators' channels when featuring their work
• Failure to properly credit constitutes copyright violation and may result in strikes

3.5 Modifications to Your Content

You grant Ourstube permission to modify your content for technical reasons only:

• Compressing for faster streaming
• Reformatting for different devices (mobile, tablet, desktop)
• Adding captions or automated subtitles
• Creating technically necessary derivatives

We will NOT edit, alter, or change the creative content of your videos without explicit permission.

4. Monetization, Earnings & Payments

4.1 Monetization Eligibility

To earn money on Ourstube, you must:

• Be at least 18 years old (or 13+ with parental consent and guardian account management)
• Meet minimum engagement thresholds (varies by region)
• Comply with all content policies and community guidelines
• Maintain an account in good standing with no active strikes
• Complete identity and tax verification
• Have a valid payment method registered

4.2 Revenue Generation

Earnings are generated through:

• AdSense/AdMob Ads — Displayed on your videos; you earn a share of ad revenue
• Viewer Rewards — When viewers watch your content, they receive rewards; you earn a portion
• Subscriptions — Monthly subscriber payments generate revenue you share with the platform
• Referral Commissions — Earn when viewers you refer watch content
• Brand Partnerships — Sponsorships and branded content (subject to disclosure requirements)
• Affiliate Marketing — Commissions from product links (requires proper FTC/regional disclosure)

4.3 Revenue Distribution & Calculation

Ourstube uses the following transparent revenue split:

Calculation Example:

• Total ad revenue from your video: $100
• Your earnings: $100 × 20% = $20
• Payment to you: $20 (before taxes and payment processor fees)

4.4 Earnings Adjustments & Reserves

Ourstube reserves the right to:

• Adjust the earnings structure with 30 days' notice
• Place earnings in reserve pending verification or investigation
• Recalculate earnings if fraud or policy violations are discovered
• Withhold payments for accounts under investigation
• Adjust earnings retroactively if ad networks audit and adjust payments

Reserve periods typically last 30-90 days during investigation.

4.5 Minimum Payout & Thresholds

• Minimum Withdrawal: $5 USD equivalent or local currency equivalent
• Minimum Balance to Monetize: Account must have earned at least $0.50 in the previous month
• Earnings Holding Period: 45 days after month-end before funds are available for withdrawal
• Maximum Monthly Withdrawal: No limit (subject to payment processor caps)

4.6 Payment Processing

• Payout Schedule: Monthly payments processed on the 15th of each month
• Payment Methods: Payoneer, Wise, JazzCash, EasyPaisa (varies by country)
• Processing Time: 3-7 business days after payout initiation
• Currency Conversion: Automatic at current market rates; we absorb conversion fees
• Payment Failures: If a payment fails, we retry up to 3 times over 30 days

4.7 Taxes & Financial Responsibility

• Tax Reporting: Ourstube reports earnings to relevant tax authorities as required by law
• Your Tax Obligation: You are responsible for calculating and paying taxes on your earnings
• 1099/Tax Forms: Tax documents provided annually or as required by jurisdiction
• Independent Contractor Status: Most creators are independent contractors responsible for self-employment taxes
• Tax Compliance: We recommend consulting a tax professional about your obligations

4.8 Disputed Payments

If you dispute a payment or calculation:

1. Submit a dispute within 90 days of the payment date
2. Provide specific details about the discrepancy
3. Our finance team reviews within 10 business days
4. We'll provide a detailed explanation or issue a corrective payment
5. If unresolved, escalate to our appeals process

5. Prohibited Activities & Conduct

5.1 Engagement Manipulation

You may NOT:

• Use bots, scripts, or automation to generate fake views, likes, or comments
• Participate in view-trading schemes or engagement pods
• Purchase artificial views, followers, or engagement from third parties
• Click your own ads or encourage others to do so
• Use click farms or incentivized clicking to inflate metrics
• Create fake accounts to inflate your own engagement
• Use VPNs or proxies to manipulate geographic data or view counts
• Engage in coordinated inauthentic behavior or astroturfing

Penalty: Immediate demonetization, content removal, and potential account termination.

5.2 Content Violations

You may NOT upload:

• Copyrighted Material — Videos, music, or content you don't own or aren't licensed to use
• Violent Content — Graphic violence, animal abuse, or content glorifying harm
• Adult Content — Sexually explicit, nude, or pornographic material
• Hate Speech — Content targeting groups based on protected characteristics
• Misinformation — False medical, financial, electoral, or conspiracy claims
• Dangerous Pranks — Content encouraging dangerous or illegal activity
• Doxxing — Publishing private information about individuals
• Spam — Repetitive, low-effort, or commercial spam content

Penalty: Content removal, copyright strikes, demonetization, or account suspension.

5.3 Policy Violations

You may NOT:

• Violate AdSense or AdMob policies (Google's platform requirements)
• Circumvent content filters or age restrictions
• Mislead viewers with false titles, descriptions, or thumbnails
• Create clickbait content designed to deceive
• Impersonate others or misrepresent your identity
• Promote illegal products or services
• Encourage policy violations by other users
• Attempt to manipulate our algorithms or moderation systems

Penalty: Demonetization, strikes, suspension, or termination.

5.4 Account Abuse

You may NOT:

• Create multiple accounts to evade bans or circumvent policies
• Share or sell account credentials
• Attempt to gain unauthorized access to other accounts
• Interfere with platform operations or security
• Use Ourstube to harass, threaten, or abuse others
• Engage in extortion or blackmail using the platform
• Violate others' privacy or intellectual property

Penalty: Immediate account termination and potential legal action.

5.5 Payment Fraud

You may NOT:

• Use stolen payment methods or fraudulent payment information
• Attempt to claim earnings you didn't generate
• Commit chargebacks or payment disputes fraudulently
• Use money laundering or sanctions evasion methods
• Exploit payment system vulnerabilities

Penalty: Account termination, legal action, and referral to law enforcement.

5.6 Suspension of Service for Violations

Engaging in prohibited activities may result in:

• Immediate content removal
• Demonetization
• Account restrictions
• Temporary suspension (7-30 days)
• Permanent account termination
• Legal action and law enforcement referral

6. Termination & Account Closure

6.1 Termination by User

You may close your account at any time by:

1. Going to Account Settings → Privacy & Security
2. Selecting "Close Account"
3. Following the confirmation steps
4. Account deletion completes within 30 days

Upon Closure:

• Your videos are removed from the platform
• Your account cannot be recovered
• Pending earnings are forfeited if not paid
• Paid earnings cannot be reclaimed (non-refundable)

6.2 Termination by Ourstube

Ourstube may suspend or terminate your account if you:

• Violate these Terms or community guidelines
• Violate AdSense or AdMob policies
• Engage in illegal activity
• Demonstrate a pattern of policy violations (three strikes)
• Refuse to comply with verification requests
• Are identified as a minor without parental consent
• Pose a security risk to our platform or users

6.3 Suspension vs. Termination

Temporary Suspension (7-30 days):

• Account access is restricted
• No new uploads allowed
• Existing content remains live but not monetized
• After period, account is restored if no further violations
• Strikes remain on your account record

Permanent Termination:

• Account is permanently deleted
• All content is removed within 24 hours
• No future access or re-registration allowed
• Pending and unpaid earnings are forfeited
• May be reported to law enforcement if illegal activity is involved

6.4 Appeal Process

If your account is suspended or terminated:

1. Receive Notification — We'll email details of the violation
2. Review Details — Understand specifically which policy was violated
3. Submit Appeal — Within 30 days, submit your appeal through the Appeals Portal
4. Provide Evidence — Include any documentation supporting your case
5. Review Period — Our team reviews within 5-10 business days
6. Receive Decision — We'll notify you of the outcome

Appeals must include:

• Your account username
• Specific policy you believe was misapplied
• Evidence or explanation supporting your position
• Any mitigating circumstances

Note: Not all appeals are successful. Severe violations (child exploitation, terrorism, etc.) are not subject to appeal.

6.5 Data Retention & Deletion

After account closure or termination:

• Your videos are deleted within 24-48 hours
• Your profile is removed from search within 7 days
• Some data may be retained for legal, tax, or security purposes
• Archived data may persist in backup systems for up to 1 year
• You may request complete data deletion under GDPR or local privacy laws

7. Liability, Disclaimers & Limitations

7.1 "As-Is" Service Disclaimer

Ourstube provides the platform "AS-IS" and "AS AVAILABLE" without warranties. We make NO WARRANTIES regarding:

• Uninterrupted service availability
• Error-free operation
• Data accuracy or completeness
• Ad network performance
• Earnings or monetization guarantees
• Third-party services or integrations

7.2 Ad Network Disclaimers

Ourstube is NOT responsible for:

• AdSense or AdMob performance issues
• Ad network policy changes or enforcement
• Fluctuations in ad rates or revenue
• Technical failures of ad networks
• Ads not displaying properly
• Ad-related fraud or click manipulation

Your Recourse: Contact Google AdSense or AdMob directly for ad network issues.

7.3 Policy Enforcement Disclaimer

Ourstube's moderation and enforcement decisions are made in good faith but are NOT guaranteed to be:

• Perfect or error-free
• Legally binding determinations of guilt or innocence
• Subject to judicial review
• Reversible if challenged in court

We maintain appeals processes for users who believe decisions were incorrect.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Ourstube is NOT LIABLE for:

• Lost earnings or revenue due to policy enforcement
• Account suspension, termination, or closure
• Content removal or demonetization
• Third-party actions or conduct
• Service interruptions or downtime
• Data loss or corruption
• Unauthorized access to your account
• Indirect, incidental, or consequential damages

MAXIMUM LIABILITY CAP: If we are found liable, our total liability is limited to the total amount you earned on Ourstube in the 12 months preceding the claim, or $100 USD (whichever is greater).

7.5 Third-Party Services & Links

• Ourstube is not responsible for third-party websites, applications, or services
• Links to external sites are provided for convenience only
• We do not endorse or guarantee third-party services
• Your use of third-party services is governed by their terms, not ours
• We are not liable for third-party conduct or content

7.6 User-Generated Content Disclaimer

• Ourstube does not endorse or verify user-generated content
• We are not responsible for content accuracy, legality, or safety
• Users post content at their own risk
• We take reasonable steps to remove violating content but cannot monitor everything
• Harmful content should be reported immediately

8. Intellectual Property & DMCA

8.1 Ourstube Intellectual Property

• Ourstube owns all rights to the platform, interface, design, and technology
• You may not copy, modify, or reproduce our platform without permission
• Ourstube's name, logo, and branding are protected trademarks
• Unauthorized use of our intellectual property is prohibited

8.2 DMCA Compliance

Ourstube respects copyright law and complies with the Digital Millennium Copyright Act (DMCA):

• To report copyright infringement, submit a DMCA notice to dmca@ourstube.com
• Include: your name, contact info, description of work, infringing URL, and signed statement

• Repeat infringers may have their accounts terminated

10. Governing Law & Jurisdiction

These Terms are governed by the laws of Pakistan and international digital law standards, specifically:

• Pakistan Electronic Transactions Ordinance (PETO) — Electronic commerce
• General Data Protection Regulation (GDPR) — For EU users
• Digital Personal Data Protection Act (DPDP) — For Indian users
• Local laws of user's jurisdiction — Where applicable

10.2 Jurisdiction & Dispute Resolution

For Disputes:

1. Negotiation — First, attempt to resolve disputes through direct communication
2. Mediation — If unresolved, disputes may go to mediation (non-binding)
3. Arbitration — Most disputes will be resolved through binding arbitration
4. Venue — Arbitration proceedings conducted in Karachi, Pakistan (or virtually)
5. Legal Action — If arbitration fails, disputes may be resolved in courts of Karachi, Pakistan

10.3 Alternative Dispute Resolution

• Users outside Pakistan may pursue disputes in their local courts
• Ourstube does not waive right to seek injunctive relief in any jurisdiction
• Class action waivers may apply in some jurisdictions

Ourstube may modify, suspend, or discontinue services:

• Some emergency changes may require immediate implementation
• Changes affecting earnings are announced 30 days in advance
• Your continued use indicates acceptance of service changes

12. Miscellaneous Provisions

12.1 Entire Agreement

These Terms constitute the entire agreement between you and Ourstube regarding your use of the platform. They supersede all prior agreements, understandings, and negotiations.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, that provision is severed, and the remaining Terms remain in effect.

12.3 Waiver

Failure to enforce any right under these Terms does not constitute a waiver of that right or other rights.

• You will comply with all platform policies
• You will not use Ourstube for illegal purposes
• All information you provide is true and accurate
